Minimum Holiday Allowance for 2024: How Much Is It?

According to the provisions of the Employment Relationships Act (ZDR-1), the minimum holiday allowance for 2024 must be equal to the minimum wage for that year, which amounts to 1253.90 euros. It is important to note that the allowance is tax-free up to the amount of the average salary in the Republic of Slovenia, which is regularly updated. Currently, the average gross salary amounts to 2144.72 euros. If the allowance exceeds the average salary, only the portion that exceeds the average is taxed.

Deadlines for Payment of the Holiday Allowance in 2024

The holiday allowance for 2024 must be paid no later than July 1, 2024. In the event of the employer’s insolvency, the payment deadline can be extended, but no later than November 1, 2024, which must be specified in the collective agreement at the industry level.

Who Is Entitled to the Holiday Allowance?

All employees who are entitled to annual leave are also entitled to the holiday allowance. If an employee is not employed for the entire calendar year, they are entitled to a proportional part of the allowance based on the number of months they were employed. For example, if the contract is concluded for five months, the employee

 receives 5/12 of the total allowance. Additionally, employees with part-time contracts receive a proportional allowance based on their working hours, except in cases specified by Article 67 of the ZDR-1.

Special Conditions for Repayment of the Allowance

If an employee receives an allowance to which they are not entitled (for example, due to termination of employment during the year), they must return the overpaid allowance. The employer can offset the 

overpaid amount with the salary payment, but only with the employee’s written consent. If the employee does not provide written consent or refuses to return the 

unjustified allowance, the employer can initiate proceedings at the competent court.

Amount of Allowance in the Private Sector

The amount of the allowance in the private sector depends on the individual employer, as the ZDR-1 stipulates only the minimum amount. When paying the allowance, it is necessary to consider the provisions of collective agreements. If a collective agreement stipulates a higher amount of allowance than the ZDR-1, the higher amount applies.
